12 Thursday, November 13, 1997 Pahrump Valley Gazette A partial blueprint for full recovery in Nye With less than twelve months remaining before the general elections that will be held in November of 1998, it is not too early for citizens in Nye County to begin seriously considering what can be done in order to overthrow the rogue government presently entrenched in Nye County. For the purposes of this article, the entrenched government that I am speaking of will be referred to as "The Opposition." The reader needs to be aware that the term "The Opposition" is not intended to mean all people in Nye County government. There are unquestionably people in Nye County, both elected and apointed, who are qualified, professional, dedicated and sincere servants of the public. Specifically "The Opposition'.' includes the Nye County Manager and his assistant, the majority of the Nye County Commission, some members of the Pahrump Regional Plan- ning Commission (PRI) and in the background, casting a large shadow, Pahrump's two largest land developers. Because of "The Opposition" such things as the $1,600 impact fee for new construction - that will quickly and effec- tively raise everyone's property taxes -is being readied to be shoved down your throat, a parcel map moratorium that favors only the largest land developers in Pahrump and prohibits further rural life-style land development has been put in place, rigged county bids and the expenditure of miUions of dollars of taxpayer funds without going through any legitimate bid pro- Mortgage Life Insurance KHWK Radio cess whatsoever take place as a matter of course. The common denominator in all this is a vast increase in power and/or monetary gain for the players involved. Orches- trating the show are the Nye County Manager and his assistant, who frequently and continuously give legal advice to the Nye i i THIS MAN:S OPINION] by Brent Mathewson County Commissioners, which is acted upon by the commission as if it were properly coming from the District Attorney's office. Le- gal advice given to Nye County, from some time back to the present, by Les Bradshaw and Rachel Nicholson has managed to embroil Nye County in lawsuits against the county totaling well in excess of 50 million dollars. Many of these lawsuits are being handled, on a contingency basis alone, by some of the most powerful law firms in the western part of the United States. A contingency basis means that these law firms will be paid nothing until and unless they win the case. Well established law fnqs do not spend time on, or accept, cases of this type unless they feel strongly that they have a "lock" on a highly favorable outcome. Looking through legal documents involving these cases reveals another common denominator. First of all, both Bradshaw and Nicholson, along with several of the Nye County Commissioners, are consistently being sued as indi- viduals, in addition to Nye County as a whole, for actions taken in violation of state and/or federal law. Second, the defense against these suits consists of blatant denials of truths which appear to be more than self-evident coupled with endless motions, appeals and re-appeals to unfavorable rulings made by the courts in an apparent attempt to delay, ensnarl and entangle the legal process from moving forward. If the average Nye County citizen was aware of just a small fraction of the human tragedy that has been, and is being, inflicted on totally innocent people because of the immoral legal defenses engaged in to defend Nve County in lawsuits of this type, the resultant outrage would truly be a thing to be- hold. The truth is that all Nye County citizens, knowingly or unknowingly, are involved in From Pahrump to Bishop has you covered! Frontage Rd. #A, Pahrump, NV I these matters whether they wish to be or not. To a much higher degree, all Nye County Commissioners are involved in these matters whether they wish to be or not. For the commissioners to claim that it is out of their hands and in the hands of attorneys representing the county's insur- anee carrier is not only morally repugnant but a misstatement of fact. Nevada law, NRS 244.165 provides that: The board of county commissioners shall have power and jurisdiction in their respective counties to control the prosecution or defense of all suits to which the county is a party. All the commissioners would have to do to properly begin the process to resolve lawsuits of this type would be to ask the present Nye County District Attorney the following straight up question: "Does Nye County have any solid legal or moral ground upon which to stand and defend this particular law- suit?" If the answer to that question came back negative for any of the lawsuits Nye County is presently engaged in, the D.A. should be instructed to negotiate a morally acceptable settle- ment in the suits involved in as quick a time period as possible. I happen to know from a highly reliable source what the D.A.'s response would be in several cases of this type. The Acker and Hyde suit, detailed in a previous column is one. The Bill Offutt (former Nye County manager) lawsuits are another. There are several more. To rely on the advice of Bradshaw and Nicholson to defend suits of this type in the manner presently being pursued by Nye County is an insult that cannot help but to stain the soul, spirit and integrity of all Nye County citizens. The county manager and his assistant are running the show, make no mistake about that. They also both serve at the pleasure of the commission. The present commission has proven itself incapable or unwilling to remove these two from their exalted appointed positions. It would seem self-evident that the present makeup of the commission should change. A guiding force of"The Opposition" is Cameron McRae by and through his position on the Nye County Commission. In 1994, McRae was re-elected to his present seat on the commis- sion. McRae ran a high priced campaign that included many full page ads in all available publications distributed in Pahrump plus an overwhelming amount of "free" press that was run as hard news coverage. McRae's political opponent in this race was a completely unknown person in the Pahrump community, ran a total of three 1/8 page ads in one publication which included a picture that made the individual appear as if he were in a police lineup. He me no public appearance, he showed up atno "meet the candidates" functions. In other words, he ran a zero cam- paign. McRae won that race for his present seat on the Nye County Commission by a grand total of seventeen votes. If there are no people in the reading audience who under- stand that this plum of power is literally there for the taking, that it can be returned to the people, then I have wasted my time writing this article. I personally hope that Cameron runs for re-election. At least then we will all know who "The Opposition" candi- date is.
