Seniors document approved

PAHRUMP--It was on the agenda at the Nye County
Commissioner's meeting Tuesday Aug 19 to reconsider the
implementation of the Plan of Operations for the Pahrump
Senior Center, but the seniors didn't get what they wanted.
Nye County Manager, Les Bradshaw, advised the com-
mission that the operations manual that county administra-
tion put together is the document that the Senior Nutrition
Program project council in Pahrump could best work with to
be in compliance with federal and state guidelines for this
type of nutrition program.
"That project council is not representing the participants,"
Bradshaw said. "We don't even need a project council if the
participants don't want one. We have to make sure the project
council is responsible to the participants. That project council
is dysfunctional and is not working. We can change that and
we can change that appointed board to an elected one. All
participants can participate in an election as long as the
election process is fair," Bradshaw said.
Nye County Commissioner Bobby Revert said, "We
need to rewrite it (the operations manual) and make it
something we can live with. I thought this was 'by the
people and for the people'...and that' s (the current operation
manual) not right."
"Right now, this plan works," Bradshaw said. "We can
amend it at any time. Once the project council gets the
operations manual, their problems will disappear."
If anyone is confused about this issue, they probably
aren't alone. Nye County administration wrote an opera-
tions manual for the nutrition program and many Pahrump
seniors were upset that it took away their voting rights to
elect their project council board. A group of seniors rewrote
the manual and presented it to the commission for their
consideration. The commission then directed Assistant
Deputy District Attorney Gary Pulliam to study both docu-
ments and make a legal document that would work for
everyone by combining the two. That would have made a
third document.
Then, according to Chairman Dick Carver, there are
actually three different documents under consideration--
bylaws, an operations manual and a policies document.
Pulliam said that Bradshaw is still working on the policies
document.
Senior spokesperson Ruth Weidenheimer said, "The
Older Americans Act dictates how this whole process should
work. I would suggest very strongly that you look at it. Your
action taken on May 6 was an illegal act. The presentation
given by the county manager that the project council was
dysfunctional that year was true, but not for the previous 18
years. I urge you to please give us back our right to vote. The
way that board was appointed was not by your own bylaws,"
she said.
Revert said, "I would like to have a legal opinion as to the
legality of the operations manual," and Pulliam said that he
would have to check it out.
Meanwhile, the commission voted" 5-0 to approve the
administration version of the operations manual.
