HEARING
NOTICE IS HEREBY
GIVEN that, pursuant to NRS
244.360, a public hearing will
be held by the Nye County
Board of County Commis-
sioners ("Board"), on the 5th
day of August, 1997, at the
hour of 2:00 o'clock p.m., in
the Commissioners' Cham-
bers, Nye County Courthouse
and William P. Beko Justice
Complex, 101 Radar Road,
Tonopab, Nevada, for the pur-
pose of considering a written
complaint with the Nye
County Clerk, alleging the
xistence of certain nuisances
(as defined by/fiRS 40.140) in
the Unincorporated Town of
Pabrump.
NRS 40.1 40 defines a "nui-
sance" as "anything which is
injurious to health, or inde-
cent and offensive to the
senses, or an obstruction to
the free use of property, so as
to interfere with the comfort-
able enjoyment of life or prop-
erty."
On the 27th day of June,
1997, a letter of complaint,
signed by Steve M. Maison,
Battalion Chief, Pahrump Fire
Department, was filed with the
Nye County Clerk, alleging
the following nuisances to be
located in Pahrump:

Pursuant to NRS 244.360
(1), on July 1, 1997, the
County Clerk informed the
Board regarding the complain-
ant; and the Board thereafter
fixed the above-noticed date,
time and place to hear the proof
of the complainant and of the
owner or occupants of the real
property whereon the alleged
nuisances are claimed to ex-
ist.
The Board will proceed to
hear the complaint and any
opponents at the above-fixed
date, time and place. The
Board may adjourn the hear-
ing from time to time, not ex-
ceeding 14 days in all. At the
hearing, the Board shall re-
ceive the proofs offered to
establish or controvert the
facts set forth in the complaint,
and on the final hearing of the
complaint, the Board shall by
resolution determine whether
or not the alleged nuisances
exist and, if one or more of
them does exist, order the per-
son or persons responsible for
such nuisances to abate the
same.
If the order is not obeyed
within five days after service
of a copy upon the person or
persons responsible for the
nuisance, the Board shall
cause the abatement of the
nuisance and make the cost of
abatement a special assess-
ment against the real prop-
erty. The special assessment
may be collected at the same
time and in the same manner
as ordinary county taxes are
collected, and shall be subject
to the same penalties and the
same procedures and sale in
case ofdeliquency as provided
for ordinary county taxes. All
laws applicable to the levy,
collection and enforcemefit of
county taxes shall be appli-
cable to such special assess-
ment.

heard regarding the above
complaint is invited to attend
and speak on the issue.

NOTICE OF NYE
COUNTY'S INTENTION
TO SELL CERTAIN
REAL PROPERTY
NOTICE IS HEREBY
GIVEN, pursuant to NRS
244.281(2), that the Nye
County Board of Commis-
sioners ("Board"), pursuant to
NRS 244.281 (I) (b), intends
to sell the following County-
owned property through a li-
censed real estate broker:
AP#08-271-06: Parcel A, file
map # 190397. Located within
Section 1, Township 2 North,
Range 42 East. 2.75 acres.
An offer for the above-de-
scribed property has been re-
ceived by the Board, in the
amount of Eighty-Two Thou-
sand Five Hundred Dollars
($82,500.00), the minimum
sales price previously set by
the Board. That offer was
brought to the Board by Trish
Ripple, dba Trish Ripple Re-
alty, Inc., a licensed real es-
hate broker.
Ms. Ripple will be han-
dling the proposed sale of the
above-described property.
Any person who is interested
in purchasing the said prop-
erty is invited to negotiate with
Ms. Ripple regarding making
an offer. New offers on the
said property will be accepted
by Ms. Ripple, for convey-
ance to the Board, until noon,
Monday, August 4, 1997. The
Board will consider and may
make a final decision to sell
the said property at its meet-
ing on Tuesday, August 5,
1997.
Offers must to be made on
standard offer to purchase
forms, and must be accompa-
nied by a ten percent (10%)
earnest money deposit which
will be fully refundable in the
event that the offer is not ac-
cepted. Otherwise, the earnest
money will be applied to the
buyer's down payment. The
earnest money deposit is to be
held in the broker's trust ac-
count until an offer is accepted
by the Board, at which time it
will be deposited into escrow.
The amount of each new
offer received by Ms. Ripple
will be revealed to all previ-
ous offerors on the said prop-
erty, so that they may improve
their offers.
The offer which may be
accepted will be the cash or
term offer which produces the
highest net.return to the
County. All offers must be at
the list price (appraised value)
or higher to be considered.
For the purpose of this sale, a
cash equivalency factor of
ninety-five (95%) will be used
in comparing cash and terms
offers. For example, if two
bids are received for the par-
cel, and they each are in the
amount of $20,000, but one if
for all cash and the other for
terms, the terms offer will be
given a cash equivalency value
of $19,000, and the cash offer
will be deemed to be the higher
of the two.
Offers may require financ-
ing by the County, providing
that the down payment is at
least twenty-five percent (25 %)
of the purchase price. The
buyer will execute a note and
deed of trust in favor of the
County, including an interest
rate fixed for the term of the
loan at one percent (1%) over
the Wall Street Journal pub-
lished prime interest rate cur-
rent at the time of acceptance
of the offer by the Board. The
term of the loan may not ex-
ceed ten (10) years.
Once an offer finally has
been acceptedby the Board, an
escrow will be opened with a
local escrow company which
will prepare the documents and
order a policy of title insur-
ance. The County and the buyer
will split the escrow fee; the
County will pay the cost of
title insurance and preparation
of the deed; and the buyer will
pay the cost of preparing the
note and deed of trust.

There current exists four va-
cancies on the Parks and Rec-
• reation Commission. These
vacancies had been held by
two Pabrump residents, one
Beatty resident and one Round
Mountain resident. These va-
cancies are four-year terms
which will expire the end of

The Board of Trustees of the
Nye County School District re-
serves the right to reject any
