Will proposed ordinance dictate vegetarianism in Nye County?

"You just turned the whole county into
vegetarians," Ralph McCracken of
Amargosa told county commissioners Tues-
day morning during a public hearing for the
proposed Animal Control Ordinance.
"No, we've got to eat beef," was the
rapid response from commission chairman
and cattle rancher, Dick Carver.
The proposed or-
dinance in section
6.04.020-C gives this
definition: "Animal"
means every wild or
domesticated living
creature, except mem-
bers of the human
race," Further into the
ordinance, section
6.04.400-A states: "It
shall be unlawful for
any person to over-
drive, over-load, tor-
ture, eat or unjustifi-
ably injure, maim, mu-
tilate or kill any animal
whether belonging to him or herself or to
another, and whether on or off the premises
of the owner of said aal."
Rachel Nicholson, pecial assistant to
County Manager Les Bradshaw, said this
does not apply to the livestock section which
is unchanged from the current ordinance.
She also said farm, ranch and agriculture is
excepted in the ordinance. Nicholson did
not say if the exempted sections address
what people can eat.
Neither did she say if 6.04.400 makes a
person a criminal if they decide to have a
member of the backyard chicken flock for
Sunday dinner. Nor, did anyone ask if the
provision makes hunting and fishing illegal.

Part B of 6.04.400 does say, "This sec-
tion does not apply to actions of licensed pest
and vermin control businesses." It doesn't
say what happens to a person who wields his/
her own can of pesticide.
McCracken expressed concern that the
proposed ordinance really goes too far in the
description of "animal." He also objected to
lack of consideration for electronic animal
constraints, and later
pointed out that sec-
tion 6.04.200-B
would make it unlaw-
ful for a horse to
"poop" on a trail.
Several others
approached the po-
dium to express con-
cern about the regula-
tions and the fear of
losing our rural atmo-
sphere."
Clark Whe61er, a
local advocate for ani-
mals, said that the or-
dinance was 90 percent to 95percent good. He
was concerned that it did not go far enough in
meeting state and federal guidelines. Wheeler
said he had discussed the proposed ordinance
with the district attorney and wished the com-
missioners would get an opinion from the
DA's office before proceeding with the ordi-
nance.
Nicholson countered criticism, stating
the purpose of the ordinance was to repeal
diverse animal control ordinances and to com-
bine them in one ordinance for clarification
and to give animal control officers clear di-
rection.
The commissioners voted unanimously
to hold a second public hearing,at a location
to be determined, July 15, 1997, at 10 a.m.
