Accused attacker of local Bartender found not guilty
On April 23, 1997, a jury consisting of six women and six
men from Fish Lake Valley and Silver Peak, found the
defendant Todd Michael Erickson, 37, not guilty. Erickson is
acarpenter from Las Vegas, and was charged with battery
with intent to kill, against Ken Seeley, 48, Goldfield resident
and at time of incident, a Goldfield bartender.
Ken Seeley, was represented by District Attorney Steve
Evenson for the State with Mr. Erickson represented by
Attorneys Steven Hill and Mr. Lerner of Las Vegas for the
Defense. The trial was held in the Esmeralda County Court-
house of the Fifth Judicial District Court with the Honorable
Judge John Davis presiding.
The alleged incident occurred the evening of Novem-
ber27,1996 at the Mozart Club when Mr. Seeley was in the
process of closing up. A woman entered the bar crying and
• ,lpset, asking for a coke, then cigarettes, then her male
_ompanion entered looking for a restroom, and on his return
from there, the alleged fight took place from the cigarette
machine to the ice machine in the kitchen with Mr. Seeley
being kicked, hit, stomped, choked, his dentures being bro-
ken.
Since it was closing time, there were no witnesses except
Mr. Erickson's female companion.
Although the State furnished a great deal of circumstantial
evidence, (photos of plaintiff's body bruises, bloodsoaked
paper towels, bar telephone with bloodspots), plus testimo-
nies of the arresting officer, the jail booking officer, the
registered nurse who was on duty the night Mr. Seeley was
taken to Nye Regional Medical Center, (the attending physi-
cian was out of town at time of trial), the state was unable to
prove battery with intent to kill.
After three lengthy days of testimonies, cross-examina-
tions, and various exhibits of evidence the defendant Todd
Michael Erickson was found not guilty.
