tion and complaint
contain specific alle-
gations of fact, affida-
vits, and exhibits in
support of its petition
and complaint.
Staff's petition and
complaint requests.
that the Commission
issue an order that
Tecopa Hot Springs
Transportation, Inc.
("Tecopa"), and its
president, Carroll
Wallace, appear before
the Commission and
show cause why they
should not be directed
to cease and disist
from operating in vio-
lation of the scope of
Tecopa's Certificate of
Public Convenience
and Necessity No.
("certificate") CPC A-
2410, Tecopa's ap-
proved tariffs on file
with the Commission,
and applicable statutes
and regulations in Ne-
vada law and why cer-
tificate CPC A-2410
should not be sus-
pended or revoked.
Staff's petition and
complaint further re-
quest that the Commis-
sion issue and order
that Elite Limousines,
Elite Limousine &
Body Guardsman Ser-
vices, Inc., and Elite
Limousine by Tecopa
(all referred to as
"Elite") and Elite's
president, George N.
Helm, appear before
the Commission and
show cause why elite
and Mr. Helm should
not be ordered to cease
and desist from operat-
ing a common carrier
limousine service un-
der the ostensible au-
thority of Tecopa's cer-
tificate CPC A-2410
and further ordered to
discontinue all com-
mon carrier limousine
services in Nevada un-
til such time as Elite
and Mr. Helm possess
a legitimate certificate
from the Commission.
Certificate CPC A-
24t0 authorizes trans-
portation service in
Nevada by Tecopa as
follows:
Transportation of
passengers and their
baggage and light ex-
press in the same ve-
hicle with passengers
between the Califor-
nia-Nevada state line
on State Route No. 372
and Las Vegas, Nevada
and a five-mile radius
of the city limits
thereof, via State
Route No. 372; State
Route No. 160 and In-
terstate Highway No.
15, serving all inter-
mediate points and the
off-route point of Blue
Diamond, Nevada.
Staff states that its
petition and complaint
demonstrate that (1)
Tecopa is operating
outside the scope of
authority contained
within certificate CPC
A-2410; (2) that by
conducting operations
never contemplated by
its certificate, Tecopa
is charging rates and
fares that have never
been submitted, filed,
or approves as tariffs
by the Commission;
(3) that Tecopa is ap-
parently brokering and
leasing its certificated
authority to limousine
operators in the Las
Vegas, Nevada, area,
including Mr. Helm;
(4) that Tecopa is in
violation of Nevada
statutes and commis-
sion regulations, in-
cluding but not limited
to those set forth in the
first paragraph of this
notice; (5) that Mr.
Helm, through Elite,
continues to operate a
fleet of limousines un-
der the purported au-
thority of Tecopa's cer-
tificate CPC A-2410,
despite having been is-
sued six citations by
Staff and having been
warned by Staff nu-
merous times that such
activities are unautho-
rized and illegal; and
(6) that review of
Tecopa's history from
the time it received its
certificate CPC A-
2410 to the present re-
veals a history of com-
plications and viola-
tions.
