ThatResolution notes that on or before December 27, 1997, a Service Plan for the proposed District was filed with the Nye County Clerk, as required by N-RS 308.030. The Board may not proceed with formation of the proposed District without first approving a %'rvioe Plan for t propos Dt. "The Board may disapprove the Service Plan upon satis- factory evidence that: 1) There is insufficient existing and projected need for orga- nized service in the area to be serviced by the proposed Dis- trict; 2) the existing service in the area to be served by the proposed District is adequate for present and projected needs; 3) adequate service is, or will be, available to the area through municipal an- nexation by other existing municipal or quasi-municipal corporations within a reason- able time and on a compa- rable basis; 4) the proposed special District is incapable of fproviding economic and suf- icient service to the area within its proposed bound- aries; 5) the area to be in- cluded in the proposed dis- trict does not have or will not have the financial ability to discharge the proposed in- debtedness, other securities or other obligations to be in- curred on a reasonable basis; 6) the facility and service standards of the proposed District are incompatible with the facility and service stan- dards of adjacent municipali- ties and special Districts; or 7) the proposed district is be- ing formed for the primary purpose of financing the cost of developing private prop7 erty. The findings of the Board shall be based solely upon the Service Plan and evidence presented at the hearing by any interested party, as defined in NRS Chapter 308. If the Service Plan is. ap- proved as submitted, a reso- lution-of approval will be is- sued by the board of commis- sioners. If the Service Plan is disapproved, the specific detailed reasons for such dis- approval shall be set forth in writing.
